JUSTICE ASHOK S.KINAGI ORAL ORDER The petitioner has filed this writ petition seeking the following reliefs: (1) Call for entire records on the file of the Respondent with regard to the case of the petitioner for regularization in W.P.No.3226/2015 (S-REG) on the file of this Hon’ble Court (Annexure-A), (2) Issue a writ/order/direction in the name of CERTIORARI, quashing the endorsement/reply dt. 06.01.2021/12.01.2021 vide No.LC/1/WA- 347/2016/32 dtd @ Bg the 06.01.2021 vide Annexure-F issued by the Respondent, (3) Issue a writ/order/direction in the nature of MANDAMUS, directing the Respondent to reconsider the case of the petitioner for regularization of his services w.e.f. 15.02.1989 vide Annexure H in No.RECH.28/4/89/1/120 dated @ Bg 15th Feb. 1989 in terms of the conditions stipulated in the case of State of Karnataka Vs. M.L.Kesari – (2010)9 SCC 247 and thus allow the above petition, - 3 - HC-KAR NC: 2026:KHC:28649 WP No. 6005 of 2023 AND (4) Pass such other necessary orders as deemed fit in the circumstances of the case along with costs of the above case in the interest of justice and equity, (5) Learned counsel for the respondent filed the statement of objections contending that the petitioner has got an alternative remedy if any approach the Central Labour Tribunal for his grievance redressal. 2. Learned counsel for the parties submits that pursuant to the stand taken by the respondent in the statement of objections, the petitioner may be permitted to approach the Central Labour Tribunal. 3. The submission is placed on record. 4. Accordingly, the writ petition is dismissed as withdrawn with liberty to the petitioner to approach the Central Labour Tribunal within a period of one month. If the petitioner approaches the Central Labour Tribunal, the - 4 - HC-KAR NC: 2026:KHC:28649 WP No. 6005 of 2023 petitioner is entitled for benefit under Section 14 of the Limitation Act. 5.
