No. 7 PG C.R.M.(M) 700 of 2026 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the B.N.S.S., 2023 in connection with Joynagar Police Station Case No.601 of 2022 dated 10.10.2022 under Sections 341/302 of the Indian Penal Code. And In the matter of : Sahidulla Gazi @ Saidulla Gazi @ Sahidulya ……………….Petitioner Mr. Joy Chakraborty Mr. Sandip Dinda…..for the petitioner 1. State is not represented in spite of receipt of notice. 2. It appears that the petitioner is in custody for about 04 years. Only 02 witnesses have been examined out of 31. There is no chance of an early conclusion of the trial. 3. Accordingly, I am inclined to enlarge the petitioner on bail considering his fundamental right of speedy disposal. 4. Accordingly, petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each out of which one must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Baruipur at South 24-Parganas and on further condition that the petitioner shall meet the Inspector-in-Charge, Joynagar Police Station once in a fortnight until further orders. 5. The petitioner shall appear before the trial court on every date of hearing until further orders and shall not 2 intimidate the witnesses and/or tamper with evidence and/or commit any cognizable offence in any manner whatsoever. 6. In the event the petitioner fails to adhere to any of the conditions stipulated above without justifiable cause, the trial court shall be at liberty to cancel the petitioner’s bail in accordance with law without further reference to this Court. 7. The application for bail is, accordingly, allowed. 8. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Apurba Sinha Ray, J.)
