1. Heard the submissions of the learned advocates appearing for the parties. 2. Peruse the material on records as well as the case diary. 3. The petitioner is in custody for more than 1 year 2 months. Co-accused is already enlarged on bail after a period of one year by a Co-ordinate Bench of this Court. 4. It is further evident that out of 40 witnesses, 4 witnesses have been examined and there is remote possibility of any early conclusion of trial. 5. Considering all aspects of the matter as well as extent of complicity of the present petitioner, this Court is inclined to allow the prayer for bail of the present petitioner. 6. Accordingly, the prayer for bail is allowed. 7. The petitioner, namely, Sonu Kumar Yadav be released on bail upon furnishing a bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of like amount
2 each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Barrackpore subject to the condition that he shall not enter the jurisdiction of Panihati without the leave of Khardah Police Station, North 24 Parganas except for the purpose of attending any other court proceedings, if any, pending against him and he shall appear before the learned trial Court on each and every day of hearing. The Court is also asked to make all endeavour to expedite the trial. 8. In the event the petitioner fails to adhere to any of the conditions stated above without any justifiable cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court. 9. The application for bail is disposed of. 10. Case diary be returned. 11.
