1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.23/2026 registered at Police Station – Chalgali, District: Balrampur-Ramanujganj (C.G.) for the offence punishable under Sections 318, 336, 338 and 3(5) of Bhartiya Nyay Sanhita, 2023.
2. Case of the prosecution, in brief, is that the complainant has made written complaint to the concerned police station is that the VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.06.19 19:46:20 +0530
2 accused persons were illegal transporting Coal by forged documents of permit of the Coal department. Based upon the written complaint, the police has registered the offence under section 318, 336, 338, 3(5) of B.N.S. against the accused persons for the aforesaid offences and only on the basis of merely suspicious the applicant has falsely been implicated in connection of this crime.

Learned counsel for the applicant submitted applicant is innocent and has falsely been implicated in the present case. It is further contended that the applicant has neither receiving any amount nor committed any aforesaid offence as alleged by the prosecution and has falsely been implicated in connection of this crime. He also submits that the applicant has never committed cheating and fraud with the complainant and the allegation made by the complainant is false and baseless against applicant. It is further contended that the applicant have neither committed alleged offence nor any kinds have been involved in this case and wrongly been arrested by the police on the basis of false allegation prepared by the complainant, therefore, he submits that the present applicant is also entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail to the applicant. He also contended that and he is not having any criminal antecedent and the accused were illegally transporting coal using forged documents related to Coal Department permits, therefore, he is not entitled for grant anticipatory bail. 3
5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the submissions advanced by learned counsel for the applicant, the nature of allegations, and the material available on record, having regard to the facts and circumstances of the case, the nature of evidence collected during investigation, the absence of any criminal history of the applicant, and without expressing any opinion on the merits of the case, this Court is of the view that custodial interrogation of the applicant does not appear necessary at this stage. Accordingly, this Court finds it to be a fit case for grant of anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Sita Ram Sandilya on executing a personal bond and one local surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court.
(b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which
