In the matter of : Sariful Molla & Anr. … Petitioners
Mr. Aatreya Mukherjee ... for the petitioners Mr. Sariful Molla, Mr. Somnath Bera ... for the State
1. It appears from the record that more than 62 kg. of ganja was recovered from the possession of the petitioners. Charge was framed on February 2026.
2. It appears that although the petitioner is in custody for more than one year, I do not find that there is any inordinate delay in proceeding with the case.
3. It appears from the record that rigors under Section 37 of the NDPS Act are not rebutted by the petitioners since the contraband articles were recovered from their possession.
4. The petitioners’ prayer stands rejected.
5. CRM(NDPS) 1145 of 2026 is dismissed.
