Accused No.1 in Crime No.841/2023 registered by Byadarahalli Police Station, Bengaluru, for the offences punishable under Sections 395, 307 and 120B of IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.841/2023 was registered by Byadarahalli Police Station, Bengaluru, for the aforesaid offences against four unknown persons based on the first information dated 12.10.2023 received from Rajendra Kumar S/o Poolchand, who is the injured victim in the present case. During the course of investigation, petitioner herein was arrested on 24.02.2026 and subsequently, remanded to judicial custody. After completing investigation, charge sheet is now filed against seven persons and petitioner is arrayed as accused No.1 in the charge sheet. His bail application filed before the jurisdictional Sessions Court - 3 - HC-KAR NC: 2026:KHC:29086 CRL.P No. 13140 of 2025 in Crl.Misc.No.1494/2025 was rejected on 16.08.2025. Therefore, he is before this Court. 4. The material on record would go to show that accused Nos.1 to 7 had conspired to commit dacoity in Vinayaka Jewellers gold shop situated at Pipeline Road, Doddagollarahatti, Benglauru, within the jurisdiction of Byadarahalli Police Station and on 12.10.2023 at about 09.00 p.m., accused Nos.1 to 4 came to the aforesaid shop in two motor bikes, while accused Nos.5 to 7 were waiting outside in a Innova car bearing Reg.No.RJ05/UA6068. Accused Nos.1 and 3, who entered the shop on the pretext of purchasing gold ear ring were examining jewelry in the shop. Accused Nos.2 and 4 thereafter entered the shop armed with weapons and threatened CW1 and CW2 with the said weapons and demanded to hand over the gold ornaments. When CW1 and CW2 refused to hand over the gold ornaments, accused No.1 allegedly took out a pistol and fired at CW2 causing grievous injury on his left hand. Thereafter, accused persons had escaped from the shop along with gold jewellery weighing about 798 grams. - 4 - HC-KAR NC: 2026:KHC:29086 CRL.P No. 13140 of 2025 5. After the accused persons were arrested, the gold jewellery which were robbed from the shop have been recovered at their instance. Petitioner is a person with criminal antecedents and material on record would go to show that there are as many as 15 cases pending against him in Rajasthan State, before various Police Stations. All the accused persons in the present case hail from Rajasthan state and they are all persons with criminal antecedents. It is under these circumstances, the learned Sessions Judge has refused to entertain the bail application filed by the petitioner. Under the circumstances, I do not find any merit in this petition.
