1. The MCC has been filed for restoration of MAC No. 2323/2019, which was dismissed for want of prosecution by this Court vide order dated 24.03.2026.
2. Learned counsel for the petitioner submits that the matter was dismissed for want of prosecution on 24.03.2026 as he could not remain present when the case was called out, since he was engaged in arguments before another Bench. It is submitted that the absence was neither deliberate nor intentional, but due to unavoidable circumstances. Therefore, considering the bona fide reasons and in the interest of justice, the petition may be restored to its original number
3. On due consideration and for the reasons assigned therein, which is duly supported by an affidavit, this Court is satisfied that sufficient cause has been shown for restoration of MAC No. 2323/2019.
4. Accordingly, this MCC is allowed. Registry is directed to restore MAC No. 2323/2019, to its original number subject to payment of costs of Rs. 5,000/- payable to the High Court Legal Aid Committee. Sd/-
