The present petition has been filed under Article-226 of the Constitution of India for illegal and arbitrary action of the respondent No.3 in not correcting and updating the name and gender of the petitioner in the educational certificates and documents and related records in the Tripura Board of Secondary Education despite furnishing all the required documents including certificate of identity of the petitioner issued by the District Magistrate & Collector under Section-6 of the Transgender Persons Act, 2019 and further, inaction and non-
response of the respondent No.3 to the representation dated 21.07.2025 and the legal notice dated 15.10.2025 made by the petitioner.

The petitioner has prayed for the following reliefs:
“a) To admit this petition, b) Call for the records, c) Issue Rule, calling upon the respondents to show cause as to why a writ in the nature of Mandamus should not be issued directing /commanding the respondent authorities to issue and update fresh educational certificates and documents such as Registration Certificate, Admit Card, Marksheet and Pass certificate of Madyamik Pariksha (Secondary Examination) in the Tripura Board of Secondary Education ("TBSE" in short) as per newly changed name and gender of the petitioner, AND/OR, d) To issue a writ in the nature of Mandamus or pass any other appropriate order or direction directing / commanding the respondent authorities to dispose of the representation of the petitioner dated 21.07.2025 forthwith, (Annexure- H) AND/OR, e) To direct the respondent authority to make appropriate compensation to the petitioner for damages and loss suffered by the petitioner due to arbitrary and whimsical action of the respondent authorities whereby the petitioner has been deprived from pursuing his further studies till date. f) Further be pleased to proceed the case under pseudonym especially in circulating the orders and judgment of this Hon'ble Court in the instant case to safeguard the right to privacy, dignity and for protection of identity discrimination and social stigma of the petitioner. AND After hearing the parties, be pleased to make the Rule absolute and/or pass such further order(s) as to Your Lordships may deem fit and proper.
AND In the interim Direct the respondents that the pendency of the present writ petition shall not operate as a bar or impediment upon the respondent authorities to issue and update fresh educational certificates and documents in the Tripura Board of Secondary Education (TBSE in short) as per newly changed name and gender of the petitioner and/or pass such further order(s) as to Your Lordships may deem fit and proper.” [4]
The present writ petition is filed against the arbitrary, unreasonable, unjust and illegal action of the respondent authorities in not issuing and updating fresh educational certificates and documents such as Registration Certificate, Admit Card, Marksheet and pass certificate of Madyamik Pariksha (Secondary Examination) in the Tripura Board of Secondary Education ("TBSE" in short) by changing name and gender of the petitioner, despite the petitioner has been legally changed his gender and obtained gender certificate and identity card from the
concerned DM & Collector as per the provision of Transgender Persons (protection of rights) Act, 2019 and rules, 2020. The petitioner made representation and visited several occasions before the office of the respondent No.2 but in vain. Such action of the respondent deprives the petitioner from pursuing his further studies which causes irreparable loss to the petitioner. [5]
Hence, the present petition has been filed by the petitioner before this Court for redress.

In view of above and having heard the learned counsel appearing for the parties without expressing any opinion on merits, this Court is of the view that ends of justice would be met if the matter is disposed of by directing the concerned respondents to consider the case of the petitioner in the light of the representation/legal notice submitted by the petitioner before the concerned authority and on due satisfaction of all the formalities shall take a decision in accordance with law, facts and rights be decided as expeditiously as possible preferably within a period of three months from the date of the receipt of the copy of this order. Accordingly, the same is ordered. Further, it is made clear that whatever the decision is taken by the concerned respondents, the same may be communicated to the petitioner. [7]
As such, the present petition stands disposed of. As a sequel, miscellaneous application, pending if any, shall stand closed. DR.T. AMARNATH GOUD, J
