The petitioners herein have prayed for quashing of the proceeding being G.R(S) case no. 209 of 2023, presently pending before the learned Chief Judicial Magistrate, Calcutta. On perusal of the written complaint, it appears that the present dispute is purely personal in nature and does not involve any public money. The parties during pendency of the proceeding, has amicably settled their dispute and to that extent, they have also executed a memorandum of understanding on 14th March, 2024. In the above backdrop and considering the compromise and settlement between the parties, no useful purpose will be served by keeping the impugned proceeding alive. It further appears that from the 2 report submitted by the Officer-in-charge, Hare Street Police Station that the opposite party has also expressed that he has no objection if the instant proceeding is being quashed. Since learned counsel appearing for opposite party no. 2 also submits that the opposite party has decided not to support the imputations levelled against the present petitioners during trial, there is hardly any chance of conviction of the present petitioners at the end of trial. Therefore, further continuance of the instant proceeding against the present petitioners will be mere abuse of the process of the court. In such view of the matter, CRR 454 of 2026 is allowed. The impugned proceeding being G.R(S) case no. 209 of 2023 arising out of Hare Street Police Station being FIR case no. 52 dated 22.2.2023, presently pending before the learned Chief Judicial Magistrate, Calcutta is hereby quashed. In view of the disposal of the main application, connected application, if any, is also disposed of. The personal appearance of the Investigating Officer is waived.
