JUSTICE SATYAVRAT VERMA ORAL ORDER 3 03-07-2026 1. Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)a, 26 and 35 of the Arms Act as well as Section 37 of the Bihar Prohibition and Excise (Amendment) Act, 2022. 3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 16.03.2026 and allegation is of recovery of two country made pistol along with a loaded live magazine and two motorcycles and a mobile phone was seized from the place of occurrence. 4. Learned counsel for the petitioner submits that petitioner was not arrested from the spot, as such, nothing was Patna High Court CR. MISC. No.32310 of 2026(3) dt.03-07-2026 2/2 recovered from his conscious possession and came to be implicated based on the fact that he is owner of one of the seized vehicles. 5. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner and submits that though petitioner was not arrested from the place of occurrence but then his name transpired based on the confessional statement of Govind Sonker. 6. At this stage, learned counsel for the petitioner seeks permission to withdraw this application with liberty to the petitioner to renew his prayer for bail after framing of charge. 7.
