1. This matter is taken up through hybrid mode.
2. The Petitioner in this writ petition prays for the following relief:-
“It is therefore prayed that this Hon'ble Court may graciously be please to admit the Writ application, Issue notice to the Opposite Parties to show cause as to why appropriate direction shall not be issued to pay due compensation to the petitioner for occupation of land vide Plot No.201/360 area Ac.0.325 dec. of land out of Ac.l.OOOdec. land corresponding to Khata No. 48/1 of Mouza Falpaju as per the bench mark valuation of the land of Mouza Falpaju within a stipulated period of time for construction of Khorda-Bolangir Rail Line Project along with 12% interest on the solatium and market value of the land from the date of acquisition till the date of payment.
And if the Opposite Parties do not show cause or show insufficient cause, issue a Writ in the nature of Mandamus, directing the Opposite Parties to pay due, adequate and fair compensation to the petitioner as per the bench mark valuation of the land of Mouza Falpaju within a stipulated period of time for construction of Khorda-Bolangir Rail Line Project along with 12%
interest on the solatium and market value of the land from the date of acquisition till the date of payment.
And any other order(s)/ Direction(s) as this Hon'ble Court deems fit and proper.
And for this act of kindness the petitioner as on duty bound shall ever pray.”
3. Mr. Acharya, learned counsel for the Petitioner submits that in the meantime the relief sought for in the present writ petition has already been granted. Hence, he prays for withdrawal of the writ petition.
4. A memo in support of his submission is filed in Court today, which is taken on record.
5. Mr. Dash, learned Additional Standing Counsel and Mr. Sethi, learned Senior Panel Counsel do not have any objection to such prayer.
6. In view of the above, the writ petition is disposed of as withdrawn.
