Opposite Party Represented by Adv. - CORAM: THE HON’BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA ORDER 24.06.2026 Order No. 01. 1. This matter is taken up through Hybrid mode. 2. Heard learned counsel for the Petitioner. Perused the CMP application as well as the prayer made therein. 3. The sole grievance of the Petitioner in the present CMP application is that the Petitioner who happens to be the decree holder has filed an application before the learned executing court on 04.02.2023 at Annexure-5 to the CMP application which is still pending for adjudication. Learned counsel for the Petitioner further contended that although such application is filed in the year 2023 and in the meantime more than 3 years’ time has elapsed, however, the learned executing court has not taken any steps to dispose of the application filed by the decree holder. 4. Having regard to the submissions made by learned counsel for the Petitioner, further on a careful consideration of the limited nature of the prayer as involved in the CMP application, this Court Page 2 of 2. deems it proper to dispose of the present CMP application at the stage of admission by directing the learned executing court, i.e., learned Civil Judge, Daringibadi, Kandhamal to make every endeavour to consider and dispose of the pending application dated 04.02.2023 at Annexure-5, in the event the same has not been disposed of in the meantime, as expeditiously as possible, preferably within a period of three months from the date of communication of a copy of today’s order. 5. With the aforesaid observations/ directions, the CMP application stands disposed of. ( A.K. Mohapatra ) Judge Anil Designation: Junior Stenographer
