ORDER: The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 408, 420, 477A, 120B and 109 IPC, in Crime No.1 of 2026, on the file of the respondent police, seeks anticipatory 1/5 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD)No.4997 of 2026 bail. 2.The case of the prosecution is that the petitioner, who was working as senior clerk, in Kulithalai Cooperative Society Bank, has taken away the pledged gold jewels by replacing the covering jewels and re-pledged the same in a private bank in the name of a private party and used the same amount for his own purpose. Hence, the Sub Registrar of Co-operative Society Bank, Kulithalai, Hence, the present case has been registered for the above said offences. 3.The learned counsel appearing for the petitioner submitted that the petitioner is not involved in any such occurrence as alleged in the FIR. The entire jewels have been returned to the Secretary of the Bank. He seeks this Court to grant anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor would submit that opposed the grant of anticipatory bail to the petitioner stating that the petitioner along with another private party, swindled the gold jewels pledged with their Bank. however, co-accused in this case has been released on anticipatory bail. 2/5 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD)No.4997 of 2026 5.Considering the facts and circumstances of the case, A2 in this case has been granted anticipatory bail by this Court and the petitioner returned the entire jewels, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. 6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Learned Judicial Magistrate NO.II, Kulithalai, within a period of fifteen days from the date on which the order made ready and on further conditions that: [a]the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity. [b]the petitioner shall report before the respondent police daily at 10.30 a.m. for a period of fifteen days and thereafter, as and when required. [c]the petitioner shall not tamper with the evidence or witness either during investigation or trial. [d]the petitioner shall not abscond either during investigation or trial.
