JUSTICE SANDEEP KUMAR ORAL ORDER 2 30-06-2026 Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners seek regular bail in connection with Lakhisarai P.S. Case No. 351 of 2024, registered for the offence under Sections 302 and 34 of the I.P.C. 3. As per the prosecution case, the petitioners are said to have committed the murder of the deceased. 4. Learned counsel for the petitioners submits that the petitioners are quite innocent and have not committed any offence. He further submits that co-accused Gulshan Kumar has murdered the deceased Lovely Kumari. The petitioners are in custody since 05.02.2026 having clean antecedents. Patna High Court CR. MISC. No.35605 of 2026(2) dt.30-06-2026 2/3 5. Learned A.P.P. for the State has vehemently opposed the prayer for bail. 6. From the perusal of the impugned order, it appears that the deceased and one Gulshan Kumar were in a relationship and when the petitioner namely Niraj Kumar @ Niraj Yadav reached the house of Gulshan Kumar, he found that the deceased was lying there in injured condition and thereafter, the petitioner, Niraj Kumar @ Niraj Yadav and Gulshan Kumar took the deceased to a doctor’s clinic where she died. Thereafter, in the presence of the petitioners and other relatives, the deceased was cremated. 7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed. 8. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Lakhisarai P.S. Case No. 351 of 2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S. 9. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of Patna High Court CR. MISC. No.35605 of 2026(2) dt.30-06-2026 3/3 adjudication of the present bail application.
