This CRLMP has been filed for a direction to the Opposite Party No. 4-IIC, Nischintakoili Police Station-cum-IO of the Nischintakoili PS Case No. 119 of 2026 to record the statement of the petitioners for the purpose of investigation at Lalbag Police Station or any P.S. at Cuttack in presence of their Advocate as they apprehend danger to their life, since the petitioner has filed a written complaint against Sri Biranchi Pati, SDPO, Salipur at Lalbag Police Station who is the immediate higher authority of Nischintakoili PS. 2. Mr. Chhatoi, learned counsel for the petitioner submits that in the meanwhile, in ABLAPL No. 5989 of 2026, this Court by order dated 12.06.2026 has directed that the petitioner shall not be arrested in connection with Nischintakoili PS Case No. 119 of 2026 corresponding to GR Case No. 209 of 2026 till the next date, subject to the condition that they shall co-operate with the investigation and appear before the I.O as and when their presence is required. 3. As vide letter dated 19.05.2026(Annexure-5) by notice dated 17.05.2026, the IIC, Nischintakoili Police Station, who is the IO in the case directed to appear in the Nischintakoili Police Station on 20.05.2026 for the purpose of investigation. 4. Mr. Chhatoi, learned counsel for the Petitioner undertakes to appear before the IIC on 29.06.2026 for the purpose of investigation. 5. As appearance of the petitioner before the IIC is necessary for the purpose of investigation and in view of the order dated 12.06.2026 passed in ABLAPL No. 5989 of 2026, I do not consider it necessary to issue any direction for recording of the statement of the petitioners at Lalbag Police Station or any other police station in Cuttack in presence of their Advocate. 6.
