This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.600/2025, registered at Police Station: Tikrapara, Raipur District- Raipur (C.G.) for the offence punishable under Sections 21(c) and 29 of Narcotic Drugs and Psychotropic Substances Act (NDPS Act). Case of the prosecution, in brief, is that on 03.08.2025, the police authorities allegedly received secret information regarding possession and transportation of contraband substance by certain persons. Acting upon the said information, the police party conducted a raid and allegedly recovered 412 grams and 87 milligrams of heroin. Thereafter, the present applicant along with other co-accused persons came to be arrested in the present matter on 03.08.2025. Hence this bail application. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. He would further submit that the mandatory provisions with regard to search and seizure were not complied with in this case. He would submit that charge sheet has been filed, applicant is in jail since 3/08/2025 and further conclusion of the trial may take quite long time. Accordingly, he prays for enlarging the applicant on regular bail. 4. Learned counsel appearing for the State/respondent would oppose the bail application and submit that the charge-sheet has been filed in the present case before the competent Court. She would further submit that total quantity of contraband article 412 grams and 87 milligrams of heroin has been recovered in this case and 402 gram heroin has been recovered from the possession of the applicant which is above the commercial quantity. She further submitted that during investigation it has been found that the present applicant is also having contacts with the drug sellers operating outside India.
She would submit that bail applications of the co-accused persons have been rejected by this Court in MCRC Nos. 10347/2025, 7965/2025, 2028/2026, 2678/2026,
3 2636/2026, 2899/2026, 2901/2026, 3972/2026 vide orders dated 23.02.2026, 27.02.2026, 23.03.2026, 01.04.2026 and 04/05/2026, as such, the applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. From perusal of the case diary, it transpires that contraband article 402 gram heroin recovered from the possession of the applicant is above the commercial quantity, further the fact that bail applications of the co- accused persons have been rejected by this Court in MCRC Nos. 10347/2025, 7965/2025, 2028/2026, 2678/2026, 2636/2026, 2899/2026, 2901/2026, 3972/2026 vide orders dated 23.02.2026, 27.02.2026, 23.03.2026, 01.04.2026 and 04/05/2026, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant Lavjeet Singh @ Bunty, involved in Crime No. 600/2025, registered at Police Station: Tikrapara, Raipur District- Raipur (C.G.) for the offence punishable under Sections 21(c) and 29 of Narcotic Drugs and Psychotropic Substances Act (NDPS Act), is rejected. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information. - Sd/-- Sd/-
