Singh, Advocate For the State :- Ms. Mahua Palit, Advocate ---- 02/28.07.2026 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State. 2. The petitioners are apprehending their arrest in connection with Pipra P.S. Case No.61 of 2024, for the alleged offences registered under Sections 316(2), 318(2), 351(2), 352 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned JMFC, Palamau. 3. Learned counsel appearing for the petitioners submits that the matter is arising out of an agreement and the allegations are made that the informant has paid amount to Satish Kumar Singh @ Bhola Singh and the said Satish Kumar Singh @ Bhola Singh has been granted anticipatory bail by learned Sessions Judge by the impugned order, however, the petitioners case have been rejected 2026:JHHC:22285 --2-- A.B.A. No. 4150 of 2026 by the same impugned order only on the ground that the petitioners have not complied the notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023. He further submits that, however, Satish Kumar Singh @ Bhola Singh has been granted anticipatory bail by learned Sessions Judge considering that allegations are civil in nature. 4. Learned counsel appearing for the State opposed the prayer and submits that the petitioners have also received the amount. 5. Considering that the main allegation is made against Satish Kumar Singh @ Bhola Singh, who has taken the money, however, allegations are made that the petitioners have also received the money partially and the learned Sessions Judge has been pleased to grant anticipatory bail to Satish Kumar Singh @ Bhola Singh by the impugned order considering that allegations are civil in nature, however, only for the non-compliance of notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 the anticipatory bail of the petitioners have been rejected. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with 2026:JHHC:22285 --3-- A.B.A. No. 4150 of 2026 two sureties of the like amount each, to the satisfaction of learned JMFC, Palamau in connection with Pipra P.S.
