Jyotsna Rewal Dua, Judge. On 31.08.2026, this Court has passed the following order:- “Notice. Mr. Sikandar Bhushan, learned Deputy Advocate General, appears and waives service of notice on behalf of the respondents. Petitioner is serving as Trained Graduate Teacher (Arts) in the respondent Education Department. He was posted at Government Model Girls Senior Secondary School Hamirpur. In terms of notification dated 18.02.2026, services of the petitioner alongwith 39 others, posted in the said school were transferred to Shaheed Captain Mridul Sharma Government Senior Secondary School on account of merger of Government Government Model Girls Senior Secondary School Hamirpur with Shaheed Captain Mridul Sharma Government Senior Secondary School. However, vide order dated 26.08.2026, incumbents who were shifted from GSSS (G) Hamirpur to GSSS (B) Hamirpur due to merger were ordered to be brought back to their previous station i.e. GSSS (G) Hamirpur. Petitioner's grievance is that out of 40 such incumbents, 39 were retained, only petitioner was singled out and has been transferred from GSSS (B) Hamirpur to GSSS Soda Dhyari, District Sirmour. Learned counsel for the petitioner, apart from discrimination, has taken one additional ground of petitioner's appointment as enumerator for Census 2027 and contends that in view of notification 1 Whether reporters of the local papers may be allowed to see the judgment? 2 of the State Government dated 02.01.2026, petitioner cannot be transferred from his present station till 31st of March 2027. In view of above, petitioner has made out a case for grant of interim order. Accordingly, operation of office order dated 26.08.2026 (Annexure P-5) shall remain stayed. Let learned Deputy Advocate General to have instructions in the matter. List on 07.09.2026.” 2. Pursuant to the aforesaid directions, learned Deputy Advocate General has placed on record instructions dated 05.09.2026, relevant portion whereof reads as under:- “In this regard, it is submitted that as per information received from Deputy Director of School Education (Ele.), Hamirpur the petitioner has not been relieved from this place of posting as the petitioner is currently assigned in Census Duty till 31.03.2027. The Principal SCMS GSSS Hamirpur (CBSE ) was directed to act as per direction contained in Sec (GAD) Govt of H.P. letter No.GAD- B(F)-2-1/2025-II dated 22.05.2026 (Annexed as Annexure P-8 (Colly) in present Writ Petition). The petitioner shall be relieved from the present place of posting after completion of his Census Duty.” 3. Keeping in view the aforesaid instructions that the petitioner would be relieved from the present place of posting after the completion of his census duty, this petition is to disposed of.
