Baghel, learned Government Advocate, appearing for the State/respondent Nos. 1 to 4. 5 2 By way of present writ appeal under Section 2 of Sub-Section (1) of the Chhattisgarh High Court (Appeal to Division Bench Act, 2006, the appellants, who were not party in the writ petition, have challenged the order dated 11.12.2024 passed by learned Single Judge in WPS No.7658/2024 (Ritesh Kumar Dwivedi & Others Vs. State of Chhattisgarh & Others), by which the writ petition filed by the writ petitioners/respondent Nos. 5 to 16 herein has been allowed and authorities have been directed to consider the candidature of the respondents herein for appointment to the post of peon/chowkidar and concerned authorities were directed to complete the entire process within a period of 120 days from the production of the copy of the order. The appellants are directly affected by the said order, while considering the case of the respondents and the notices have been issued to the appellants herein for cancellation of their appointment made on 12.09.2014, 10.07.2015, 01.02.2016. 3 At the outset, learned Senior Advocate appearing for appellants submits that during pendency of the appeal, the State Government has taken a decision that instead of disturbing the appellants, who were working for last more than 10 years, the writ petitioners/ respondent Nos. 5 to 16 herein were accommodated and the said statement has been made in the contempt petition filed by the writ petitioners / respondent Nos. 5 to 16 herein as CONT No. 255 of 2025 on 06.01.2026, therefore, in view of the same, he wants withdraw the instant appeal. 6 4 Accordingly, the instant appeal is dismissed as withdrawn in view of order dated 06.01.2026 passed in CONT No. 255 of 2025 the writ petitioners/ respondent Nos. 5 to 16 herein.
