PUBLIC PROSECUTOR 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL REVISION CASE NO: 498 OF 2026 JUDGMENT: The present Criminal Revision Case has been filed by the petitioner challenging the judgment dated 08.01.2026 in Criminal Appeal No.66 of 2024 by the learned Sessions Judge, Kurnool. 2. Heard Sri Ineni Venkata Prasad, learned counsel for the petitioner and Sri P.Somayaji, learned Additional Public Prosecutor representing on behalf of the State. 3. Perused the Record. 4. As can be seen from the impugned judgment, the petitioner herein preferred an appeal against the order of confiscation passed by the learned Joint Collector and Additional District Magistrate, Nandyal, in Rc.CS1/26/2023 dated 18.06.2024, wherein the learned Sessions Judge, upon due consideration, opined that the confiscation order reflects that no ample opportunity was afforded to the petitioner to establish his defence. It was further observed that no steps were taken to draw samples from the seized stock of rice to ascertain whether the same was meant for distribution under the Public Distribution System or otherwise. Accordingly, the learned Sessions Judge allowed the appeal, setting aside the confiscation order dated 18.06.2024, and remanded the matter to the Joint Collector and Additional District Magistrate for fresh consideration, directing that due opportunity may be given to the petitioner to submit his written statement and documents, if 4 any, in support of his case and pass appropriate orders within a period of three months from the date of the said judgment. 5. In the light of the observations made by the learned Sessions Judge vide judgment dated 08.01.2026 in Criminal Appeal No.66 of 2024, it is apposite to dispose of the present revision with a direction to the learned Joint Collector and Additional District Magistrate, Nandyal, to look into the issue in Rc.CS1/26/2023 and take appropriate decision over the matter as expeditiously as possible, preferably within a period of two (2) months from the date of receipt of copy of this judgment. 6. Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous applications pending, if any, shall stand closed. __________________________________________ DR.
