This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of B.A. No.3667 of 2026 to its original file. Learned counsel for the petitioner submits that B.A. No.3667 of 2026 has been rejected as not pressed vide order dated 19.06.2026. It is next submitted that on 19.06.2026, the counsel for the petitioner was out of station due to illness of his father, hence he could not appear before this Court when the case was called out resulting in dismissal of the said B.A. No.3667 of 2026. It is then submitted that the non-appearance of the learned counsel for the petitioner was neither deliberate nor intentional. It is next submitted that the petitioner has very good grounds to agitate in the said B.A. No.3667 of 2026 and unless B.A. No.3667 of 2026 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that B.A. No.3667 of 2026 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioners, B.A. No.3667 of 2026 is restored to its original file to the stage at which, it was before its dismissal.
