AG Mr. Swapan Banerjee Ms. Sumita Shaw Mr. Soumen Chatterjee …for the State PER, AJAY KUMAR GUPTA, J.:- 1. Affidavit-of-service, filed by the petitioner, is kept with record. 2. Heard both sides. 3. In course of hearing, both the parties agree to dispose of this case by directing the Block Development Officer, Goalpokher-1 Development Block, Uttar Dinajpur to consider the representation dated 07.01.2026 (annexure P/3 to this writ petition) within a stipulated period. 4. In view of the submissions made by the learned counsels for the parties, we feel that the purpose of filing this PIL would be served if the matter is disposed of with the following directions:- 2 a. The petitioner shall re-submit his aforesaid representation dated 07.01.2026 (annexure P/3 to this writ petition) before the said BDO along with copy of this order and in turn, the BDO shall consider and decide the representation in accordance with law/guidelines within 45 days therefrom. b. The entire exercise, as directed above, shall be carried out and completed by the concerned respondent positively within stipulated time. c. While considering the representation, the concerned respondent shall consider all other documents annexed with the representation and their applicability in the case. d. It is made clear that this Court has not gone into the merits of the claim of the petitioner in any manner. e. It is further made clear that the concerned respondent shall pass its reasoned decision in accordance with law independently without being influenced of any observation, whatsoever, made hereinabove. f. After the reasoned decision is arrived at by the concerned respondent, the same shall be communicated to the petitioner positively within one week from the date of the said reasoned decision. 3 5. On the above terms, this writ petition being WPA (P) 74 of 2026 stands disposed of, without any order as to costs. 6. Since no affidavits exchanged or filed, all the allegations whatever made in the writ petition are deemed not to have been admitted by the concerned respondent. 7. All the parties shall act on the serve copy of this order duly downloaded from the official website of this Hon’ble Court. 8.
