1. Admittedly, there is a dispute raised by the petitioner seeking appointment of an Arbitrator. The respondents are not filing reply to this application, despite service.
2. As per Clause 34 of the contract upon there being any dispute between the parties, the case has to be placed for arbitration and the dispute has to be decided through Arbitrator.
3. This application has been pending for filing of reply since long and, therefore, no further time is granted. A notice was sent by the petitioner for appointment of an Arbitrator with respect to deciding the claim of non-payment of pending bills as well as on the ground that before the completion of the terms of contract,
[2026:RJ-JP:15395] (2 of 2) [ARBAP-8/2025] another person was appointed to perform the contract of printing, but the notice was also left unanswered.
4. This Court, with the consent of learned counsel for the parties, appoints Mr. Harvinder Singh, (Retd. District & Sessions Judge), R/o Plot No.D-231A, Flat No.102, Tulsi Marg, Madho Singh Circle, Bani Park, Jaipur-302016 to act as Sole Arbitrator and to decide all issues without prejudice to the rights and contentions raised in the present application. The arbitration fees shall be determined in accordance with the Fourth Schedule of the Arbitration & Conciliation Act, 1996 (hereinafter referred to as ‘the Act of 1996’), as amended. The fee of the Arbitrator will be equally borne by both the parties. The place of arbitration shall be at Jaipur.
5. The Arbitrator is requested to complete the proceedings as per time limit specified under Section 29A of the Act of 1996.
6. The arbitration application is allowed accordingly.
7. Copy of this order be sent to the appointed Sole Arbitrator.
