Learned counsel for the petitioner submits that the petitioner is in custody since 01.06.2026 in connection with Mandu Kuju P.S. Case No.122 of 2026, registered under Sections 126 (2), 127 (2), 115 (2), 74, 75, 3 (5) of BNS and Section 8 and 10 of POCSO Act, now pending in the court of learned Sessions Judge, Ramgarh. 3. The learned counsel for the petitioner submits that the petitioner has been falsely made accused in this case on account of property dispute. The petitioner is the neighbor of the victim. He also submits that it has been wrongly stated in the F.I.R. that the petitioner is 55 years of age although the petitioner is 75 years of age. 4. The learned counsel for the State has opposed the prayer for bail and submitted that there is direct allegation against the petitioner and the investigation is still pending. The fact that investigation is still going on is not disputed by the learned counsel for the petitioner. 5. After hearing the learned counsels for the parties and considering the direct allegations made against the petitioner and the investigation is still going on, this Court is not inclined to enlarge the petitioner on bail at this stage. 2026:JHHC:22050 2 6. However, the petitioner may renew his prayer for bail after framing of charge and the case of the petitioner will be considered depending upon the materials collected during investigation and at that stage, the statement of the victim under Section 183 BNSS will also be called for. 7.
