JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayer: "PRAYER WHEREFORE, it is prayed before this Hon'ble Court that: a. Issue a Writ of Mandamus directing the Hon'ble Vth Additional City Civil and Session Judge at Bangalore (CCH- No.13) to dispose of the Final Decree Proceedings - 4 - HC-KAR NC: 2026:KHC:27680 WP No. 16937 of 2026 filed by Respondent No.5 for partition of suit schedule properties by metes and in FDP No.170/2016 as expeditiously as possible within the outer limit of 3 months; b. Issue any other appropriate Writ, Order or Direction/s as this Hon'ble Court deems fit under the facts and circumstances of the case, in the interest of justice and equity." 2. Learned Senior counsel appearing for the petitioner submits that the FDP proceedings are of the year 2016 and on one reason or the other, it is being adjourned and pending on the file of Vth Additional City Civil and Sessions Judge at Bangalore. 3. Considering the submissions of the learned Senior counsel for the petitioner and the fact that the FDP is pending from the year 2016, this Court deems it appropriate to pass the following order: ORDER i. Accordingly, the writ petition is disposed of requesting the trial Court to dispose of FDP.No.170/2016 as expeditiously as possible, but not later than 6 months. - 5 - HC-KAR NC: 2026:KHC:27680 WP No. 16937 of 2026 ii. This Court is not issuing notice to the respondent as no adverse orders are passed and disposal of the case is in the interest of both the parties. iii. All I.As. in this petition shall stand closed.
