JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed questioning the order passed on I.A.No.14 in O.S.No.630/2013 dated 12.03.2026 passed by the III Additional Civil Judge and JMFC, Shivamogga, whereby the Trail Court has permitted the plaintiff to amend the plaint. 2. While passing the said order, the Trail Court has observed that this case is called out, the counsel for the defendant submits that IA No.14 may be allowed on cost and accordingly, the trial Court has allowed the application. 3. The defendant comes up before this Court and submits that by allowing this IA No.14, a document is executed in the year 2013 is barred by limitation and the Trial Court ought not to have allowed the said application. 4. Having heard the learned counsel for the petitioner, perused the material on record. This Court is unable to appreciate the said submission, when a concession is made before the trial Court stating that they have no objection basing on that the trial Court has passed an order. - 4 - HC-KAR NC: 2026:KHC:27345 WP No. 16805 of 2026 5. Now it is submitted before this Court that the Junior counsel without instructions made such a submission. If that is so, it should have been brought to the notice of the Trial Court and should have sought appropriate relief from the trial court. But he cannot come before this Court questioning the said order. 6. In that view of the matter this Court, this Court is passing the following: ORDER i. Accordingly, the writ petition is disposed of, leaving it open to the petitioner to bring it to the notice of the Trial Court that such a concession made by the Junior Advocate was without instructions and to seek appropriate reliefs from the Court. ii.
