2.
Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that similarly placed co-accused Ramkesh was granted bail by the Co-ordinate Bench vide order dated 25.08.2025, observing the fact that co-accused Ramlakhan was using the bank account of Ramkesh and Ritesh. The Co-ordinate Bench also noticed at para-8 that as the main accused Ramlakhan has been granted bail by the Co-ordinate Bench on 11.06.2025, we have no other option except to grant bail to the co-accused Ramkesh. It is also contended that the petitioner as his case is identical to the Ramkesh. The investigation also revealed that the petitioner mobile sims and accounts were used by the other co- accused Ramlakhan. The main accused Ramlakhan against whom there is specific allegation that he used the sim of the petitioners and also deposited the amount in their account has already been enlarged on bail by the Co-ordinate Bench vide order dated 11.06.2025 and the case of the petitioners is on better footing then the co-accused Ramlakhan. There is no direct allegation against the petitioners that they committed cyber fraud. The mobile sims of the petitioners were found in the possession of the co-accused Ramlakhan and he misused their sims and account. The petitioners are in custody since long and there are no criminal antecedents against the present petitioners and the trial of the case may take considerable time, therefore, these bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed these bail applications and contended that the petitioners provided their sims and account number to the other co-accused Ramlakhan and
[2026:RJ-JP:16854] (3 of 3) [CRLMB-4163/2026] in their account, huge amount was deposited on account of cyber fraud committed by co-accused Ramlakhan, therefore, considering the above facts, the bail applications of the accused-petitioners may be dismissed. 4. Heard and perused the material available on record. 5. The similarly placed co-accused Ramkesh has been enlarged on bail by the Co-ordinate Bench with the observation that as the main co-accused Ramlakhan who has used the accounts of the petitioner has already been enlarged on bail.
Therefore, considering the arguments advanced by learned counsel for the petitioners and after going through the contents of the factual report and order passed in the matter of other co-accused Ramkesh by the Co-ordinate Bench, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely:
1. Ritesh Son Of Teekaram, 2. Ganesh Son Of Jaikishan and
3. Pahalwan S/o Kedar, in connection with FIR No.160/2025 registered at Police Station Mantown, District Sawai Madhopur, shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
