JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 and 2 are before this Court calling in question registration of a crime in Crime No.1/2026, pending before the VIII Additional Chief Judicial Magistrate, Bengaluru City, for the offence under Section 305 of the BNS, 2023. - 3 - HC-KAR NC: 2026:KHC:27502 CRL.P No. 1982 of 2026 2. Learned counsel for the petitioners and respondent No.2 would in unison submit that during the subsistence of these proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed an application under and a joint affidavit before this Court seeking permission to compound the offence. 3. The joint affidavit reads as follows: “We, 1). Smt. Nasreen Begum W/o. Mr. Meer Fayaz Ali Quraishy aged about 62 years, and: 2). Nabeel Ahmed S/o. Mrs. Nasreen Begum Aged about 38 years, both residents of No.442, 7th Cross, 2nd Block, R.T.Nagar, Bengaluru-560032, presently R/at Flat No.555, 4th Cross, HMT Layout, R.T.Nagar, Near R.T.Nagar Bus Depot, Bengaluru-560032. And: 3). Meer Fayaz Ali Quraishy S/o. Late Meer Abdul Ameed Quraishy, aged about 83 years, R/at. No.442, 7th Cross, 2nd Block, R.T.Nagar, Bengaluru-560032, do hereby solemnly affirm and state on oath as follows: 1. We submit that, the petitioner Nos. 1 and 2 are Accused Nos. 1 and 2 respectively in R.T. Nagar Police Station Crime No.01/2026 for the alleged offence punishable under Section 305 of the Bharatiya Nyaya Sanhita- 2023, on the file of the learned VIII Addl. Chief Judicial Magistrate, Bengaluru City. The respondent No.2 is defacto complainant. 2. We submit that, the petitioners have filed this petition to quash the F.I.R in R.T. Nagar Police Station Crime No.01/2026 for the alleged offence punishable under Section - 4 - HC-KAR NC: 2026:KHC:27502 CRL.P No. 1982 of 2026 305 of the Bharatiya Nyaya Sanhita-2023, on the file of the learned VIII Addl. Chief Judicial Magistrate, Bengaluru City. 3. We submit that, the petitioner No.1 is wife and respondent No.2 Is her husband. The Petitioner No.2 is son of the petitioner No.1. 4. We submit that, the petitioner No.1 and the respondent No.2 have filed following cases against each other which are pending: 1) We state that the Petitioner No.1 has filed O.S.No.8798/2025 pending before City Civil and Sessions Judge (CCH-43) against the Respondent No.2 and others. ii) We state that the Respondent No.2 has filed M.S.C.No.137/2025 pending before Assistant Commissioner, Bengaluru South against the petitioners. iii) We state that the Respondent No.2 has filed O.S.No.244/2026 pending before City Civil and Sessions Judge (CCH-32) against the petitioners. 5. We submit that, at the instance of the elders and well- wishers the petitioners and the respondent No.2 have amicably settled all their differences, litigations and disputes. They have withdrawn the allegations made against each other. 6. We submit that, the respondent No.2, out of his own free will, without any force or duress has no objection to quash the F.I.R registered against the petitioners in this case, on the following terms and conditions: i. The Petitioners and Respondent No.2 shall withdraw the cases filed by them against each other respectively on their own cost. ii. The Respondent No.2 shall execute Gift Deed in favour of Petitioner No.1 and handover the physical possession of the schedule property bearing No.21 and 22 of V.P.Katha No.46, Assessment No. 46, EPID No. 3445610992, situated at Hennur Village, Kasaba Hobli, Bengaluru North Taluk, now which comes under BBMP/GBA, HBR Layout, Bengaluru- 560043. Ward no. 24-HBR Layout, Measuring East to West - 5 - HC-KAR NC: 2026:KHC:27502 CRL.P No. 1982 of 2026 30 Feet, North to South 42 Feet, totally measuring 1260 Sq Ft. comprise of land and building, along with original title deeds, rental agreements with attornment of tenancy letters to the First Petitioner and also to intimate the tenants therein. iii. The Petitioner No.1 shall execute conveyance deed/gift deed in favour of Respondent No.2 and handover physical possession of the schedule property bearing old No.14, Formerly Sy No.27/2, now BBMP No.62, 7th Cross, Hebbal, Ganganagar Layout, Bengaluru, PID No.98-61-62, EPID No.4775466420, Comprise of land and building, Measuring East to West 30 Feet, North to South 43 Feet, totally measuring 1290 Sq Ft. iv. That the Petitioner No.1 shall withdraw the aforesaid case in O.S.No.8798/2025 pending before City civil and Sessions Judge (CCH-43). v. That the Respondent No.2 shall withdraw M.S.C.No.137/2025 pending before Assistant Commissioner, Bengaluru South against the petitioners. vi. That the Respondent No.2 shall withdraw O.S.No.244/2026 pending before City Civil and Sessions Judge (CCH-32) against the petitioners. vii. The Petitioner/s shall handover the Car bearing Reg No. KA30-M-8790 Skoda Activia to the son of 2nd respondent and their son/RC owner and they shall acknowledge the same. viii. The respondent No.2 shall hand over DD for a sum of Rs.10 (Rupees Ten Lakhs only) to the petitioner No.1 by way of refund/return of the amount in the following manner: (a) D.D. bearing No. 743161 for sum of Rs. 5,00,000/- dt 02/06/2026; and (b) D.D. no. bearing No. 743160 sum of Rs. 5,00,000/- dt 02/06/2026, both the D.D. in Favour of Petitioner No. 1 Drawn on Bank of Baroda, Ganganagar Branch, Bengaluru. 7. We submit that, the petitioner No.1 and the respondent No.2 shall execute the conveyance deed / gift deed in favour - 6 - HC-KAR NC: 2026:KHC:27502 CRL.P No. 1982 of 2026 of each other within 7 working days appearing before concerned Sub-Registrar from this day and later withdraw the aforesaid cases filed by each other against each other within no time/within 7 days. 8. The petitioners and respondent No.2 states and agreed that they shall not make any claim against each other in respect of any movable /immovable property either existing or to be acquired in future by either party. 9. The petitioners and respondent No.2 states and agreed that they shall not interfere in any manner in the life nor make any allegations against each other nor claim the aforesaid properties in future, and both parties are free and they are entitled to lead their life Independently and deal with it as per their choice without any objection, interference by either party. 10. We submit that, the respondent No.2, out of his own free will, without any force or duress has no objection to quash the F.I.R registered against the petitioners in this case. WHEREFORE, we pray that, this Hon'ble Court may be pleased to allow the application and quash the F.I.R against the petitioners In R.T. Nagar Police Station Crime No.01/2026 for the alleged offence punishable under Section 305 of the Bharatiya Nyaya Sanhita-2023, on the file of the learned VIII Addl. Chief Judicial Magistrate, Bengaluru City, in the interest of justice and equity. What is stated above is true and correct to the best of our knowledge, information and belief.” In the light of the afore-quoted joint affidavit of the parties, I deem it appropriate to terminate the proceedings against the petitioners, as the dispute and the allegations are between the individuals and not against the State. - 7 - HC-KAR NC: 2026:KHC:27502 CRL.P No. 1982 of 2026 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is disposed. (b) The impugned crime in Crime No.1/2026, pending before the VIII Additional Chief Judicial Magistrate, Bengaluru City, qua the petitioners, stands quashed.
