JUSTICE VINOD KUMAR BHARWANI Order 20/04/2026 : The present application has been filed on behalf of the applicant/appellant, namely Yogendra @ Kalla under Section 430 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking interim bail/ suspension of sentence on the ground of the marriage of his sister, namely Sonam, which is scheduled to be solemnized on 26.04.2026. Submissions of learned counsel appearing on behalf of the applicant-appellant are that the marriage of the applicant's sister, namely Sonam is to be solemnized on 26.04.2026. As per marriage card enclosed, the ceremonies would starts from 20.04.2026 onwards. The applicant is the only male member available to manage the marriage ceremony, and his presence is necessary to perform all rituals in accordance with Hindu Customs. Hence, it is prayed that the applicant may be granted interim bail/suspension of sentence. [2026:RJ-JP:16663] (2 of 2) [SOSA-671/2026] In compliance of the order dt.10.04.2026 passed by this Court, learned Public Prosecutor for the State, while submitting the verification report, has verified the factum of the marriage of the applicant's sister. The aforesaid report is taken on record. Heard. Perused the material made available on record. Taking into consideration the submission made by learned counsel appearing for applicant-appellant and the fact that the aforesaid marriage is going to be solemnized on 26.04.2026, but without expressing any opinion on the merits/demerits of the case, in the interest of justice, this Court deems it just and proper to enlarge the applicant on interim bail/ suspension of sentence, at this stage. Accordingly, the 3rd interim suspension of sentence application is allowed and it is, hereby, directed that the Superintendent/concerned authority, District Jail, Karauli, shall release the applicant, namely Yogendra @ Kalla on interim bail, which shall commence from the date of his actual release forthwith, upon furnishing his personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the Superintendent/concerned authority, District Jail, Karauli with the stipulation that he shall surrender himself before the Superintendent/ concerned authority, District Jail, Karauli, after completion a period of ten days at 05:00 P.M. from the date of his release. He shall also maintain peace and tranquility during the period of interim bail. In case, he fails to surrender on the stipulated date, the jail authority shall proceed in accordance with law.
