1. Present petition has been filed under Section 482 of BNSS seeking anticipatory bail in case FIR No. 27 dated 08.04.2026, under Sections 118(1), 115(2), 191(3), 190, 126(2) of BNS(Section 118(2) of BNS was added later on), registered at Police Station Ghuman Kalan, District Gurdaspur. 2. There are a total of four accused persons, namely: (i) Jatinder Singh son of Nirmal Singh, armed with a datar; (ii) Rajinder Singh son of Nirmal Singh, armed with a datar; (iii) Nirmal Singh son of Nazar Singh, armed with a baseball bat; and (iv) Manjit Singh son of Kulwant Singh, armed with a baseball bat. As per allegations, complainant, Parminder Singh, and his friend- Manish Kumar, were traveling in a jeep toward Gurdwara Tahli Sahib. Upon spotting a red tractor parked in the middle of the road RASHMI 2026.05.27 18:08 I attest to the accuracy and integrity of this document
CRM-M-31036-2026 2 leading to Gurudwara Sahib, Manish Kumar stepped out of the jeep to ascertain the reason for the obstruction. Accused persons, who were together, stepped down as well. First, accused-Nirmal Singh raised a lalkara. Thereupon, accused-Rajinder Singh struck the complainant on the left side of his chest with datar, and subsequently attacked him below the navel. Petitioner-Jatinder Singh, then aimed a datar blow at the complainant’s head; however, when complainant raised his left hand in defense, the blow struck his little finger. Jatinder Singh made another attempt to strike the complainant's head, but complainant raised his right hand, resulting in an injury that severed the thumb and nail of his right hand. Jatinder Singh delivered two more blows, striking the complainant’s right arm and right leg. After the complainant fell to the ground, Rajinder Singh struck him again on the back. When an alarm was raised, his companion, Manish Kumar, stepped forward, and approximately 7 to 8 other bystanders gathered at the spot.
Nirmal Singh then struck Manish Kumar three times with a baseball bat, hitting him on the head, left shoulder, and left thigh. Manjit Singh also gave two blows with a baseball bat on the head of Manish Kumar. 3. In view of the facts and circumstances of the case, this Court finds that the allegations against petitioner are of a grave and serious nature. Petitioner is specifically alleged to have delivered four distinct blows with a sharp-edged weapon, namely datar, directly targeting the complainant. These blows resulted in multiple injuries, including two RASHMI 2026.05.27 18:08 I attest to the accuracy and integrity of this document
CRM-M-31036-2026 3 simple injuries and two grievous injuries, one of which led to the severe consequence of the complainant’s right thumb, along with the nail, being completely chopped off. Considering the specific role attributed to the petitioner and the brutal manner in which the assault was executed, this Court is of the considered opinion that no ground for anticipatory bail is made out. Thus, present petition is hereby dismissed.
