CORAM:
HON’BLE MISS JUSTICE SAVITRI RATHO
ORDER
Order No. 06.04.2026
(Through hybrid Mode)
01.
1. This CRLMP has been filed for a direction to the Opposite Party Nos.2 to 4 to execute the NBW pending against the Opposite Party No.5 in connection with 1.C.C. No. 19 of 2025 in the file of the learned J.M.F.C., Kesinga.
2. There are two Opposite Parties no. 2 in this case. But it is apparent that Opposite Party No.1 – State of Odisha has been described as Opposite Party No.2 due to typographical error. Opposite Party No.2 is the Superintendent of Police, Kalahandi and Opposite Party No.3 is the Superintendent of Police, Bolangir.
3. At this juncture, this Court is of the view that no direction is required to be issued to the two S.Ps. for execution of NBW.
4. Mr. Ashok Kumar Apat, learned Additional Government Advocate produces the instructions dated 24.03.2026 of the Superintendent of Police, Kalahandi who has been informed by the I.I.C., Kesinga Police Station that Opposite Party No.5 – Pinkibai Agrawal belongs to Saintala Police Station which is under Bolangir district and her warrant has been sent to her native place.
5. Since the I.I.C., Saintala Police Station is not an Opposite Party in this case, the CRLMP is disposed of with the expectation that the NBW issued against Opposite Party No.5 shall be executed by the I.I.C., Saintala Police Station within a reasonable time, if there is no legal impediment.
6. Urgent certified copy of this order be granted on proper application.
