ORAL ORDER
1. Learned Additional Government Advocate accepts notice for respondents No. 1 and 2.
2. Petitioner is before this Court seeking for the following reliefs: a) issue a writ of certiorari or any other writ or Quash tender Enquiry bearing No.DTWO/2025- 26/IND0105 dated 06.03.2026 (Annexure - A) issued by the Respondent No.2 and consequently call for fresh tender; b) issue a writ of certiorari or any other writ or direction declaring that the tender conditions at Section VII: Qualification Criteria at Sl. No.6 (a), 8, 10, 13 & 16(f) of the Qualification Criteria of the tender enquiry

No:DTWO/2025-26/IND0105 dated 06.03.2026 (Annexure - A) as illegal and void. c) issue a writ of mandamus or any other writ directing the Respondent No.2 consider the representation dated 01.04.2026 (Annexure - B); and d) Issue such other writ or order or direction as this Hon'ble Court may deem fit and necessary in the circumstances of the case.
3. This Court vide order dated 06.04.2026 had passed certain interim orders.
4. Learned Additional Government Advocate who appears today for the State submit that the State wishes to withdraw the tender and issue a fresh tender notification and in this regard a memo has been filed. His submission is that issue of fresh tender could not be made due to the interim order dated
06.04.2026.
5. Faced with the above situation, learned counsel for the petitioner submits that he has no objection if, the present tender is withdrawn and a fresh tender is issued with liberty to the petitioner to participate in the fresh tender.

6. In that view of the matter, I pass the following:
ORDER (i) Writ petition is partly allowed. (ii) The respondents are permitted to withdraw the tender bearing No.DTWO/2025-26/IND0105 dated 06.03.2026 at Annexure - A and issue a fresh tender within a period of 15 days from the date of receipt of a copy of this
order. (iii) Needless to say that petitioner and anyone else who wishes to participate in the said tender would be entitled to so participate. (iv) Interim order earlier granted stands vacated. (v) Pending interlocutory applications stand disposed of.
