Accused no.1 in Crime No.363/2025 registered by Byatarayanapura Police Station, Bengaluru City, for the offences punishable under Sections 109, 190, 351(2), 352, 351(3) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.363/2025 was registered by Byatarayanapura Police Station, Bengaluru City, for the aforesaid offences against the petitioner and seven others based on the first information dated 31.10.2025 received from Sunil S/o Bylappa who is the injured victim in the present case. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.10730/2025 before the jurisdictional Sessions Court, which was rejected on 11.12.2025. Therefore, he is before this Court. 4. In the first information dated 31.10.2025, it is stated that on the said date about 4.30 p.m., petitioner and one Lokesh who are auto rickshaw drivers were quarrelling with each other. - 3 - HC-KAR NC: 2026:KHC:29357 CRL.P No. 6580 of 2026 First informant, who is also a auto rickshaw driver interfered and thereafter Rahul and Lokesh had gone away. On the same day at about 6.30 p.m., Rahul and his friends allegedly confronted the first informant and after abusing him, assaulted him with deadly weapon causing injuries. 5. The medical records of the injured victim would go to show that he has suffered only simple injuries in the incident in question and he was treated as an out-patient. It is not in dispute that the petitioner has no criminal antecedents. He has undertaken to co-operate with the police for the purpose of investigation. Therefore, I am of the opinion that petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.363/2025 registered by Byatarayanapura Police Station, Bengaluru City, for the offences punishable under Sections 109, 190, 351(2), 352, 351(3) of BNS, 2023, subject to the following conditions: - 4 - HC-KAR NC: 2026:KHC:29357 CRL.P No. 6580 of 2026 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4. The petitioner shall not involve in similar offences in future. 5. The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. Sd/- (S VISHWAJITH SHETTY) JUDGE KK
