This petition had been filed for transfer of Criminal Motion No.20 of 2024 titled as Samit Mahata vs. State of West Bengal & Anr. and M. Case No.97 of 2021 titled as Koyel Naskar Mahata vs. Samit Mahata, from the court of learned Juidcial Magistrate, Baruipur, South 24 Parganas to any other court of competent jurisdiction. 2. The petitioner has invoked the jurisdiction of this court for transfer of these proceedings as there was allegedly an incident in which the learned lawyer for the opposite party no.2 wife had beaten the petitioner. 3. In this regard a report was called by this Court from the office of the learned District Judge, Alipore, South 24 Parganas. Learned District Judge, Alipore, South 24 Parganas in terms of 2 the report had sent a confidential report in sealed cover. The Court has gone through the report. Let it be taken on record. 4. Perusal of the report indicates that in pursuant to the complaint dated 9th June, 2025 of parent of Sri Samit Mahata i.e. the petitioner against misbehavior/physical assault by Sri Supratim Ghosh inside the court and in presence of the learned Magistrate, an enquiry was conducted by the learned Additional District & Session Judge, First Court, Baruipur, South 24 Parganas and report was duly submitted to this court through Registrar(Inspection-I), High Court, Appellate Side, Calcutta. 5. The report has indicted the said lawyer. However, without going into the said report, the court considers that it would be in the interest of justice to withdraw both the cases from Baruipur court. 6. After hearing both the parties and with the consent of both the parties Criminal Motion No.20 of 2024 titled as Samit Mahata vs. State of West Bengal & Anr. and M. Case No.97 of 2021 titled as Koyel Naskar Mahata vs. Samit Mahata, are withdrawn from the court of learned Judicial Magistrate, Baruipur, South 24 Parganas and transferred to the court of competent jurisdiction at Alipore, South 24 Parganas for further trial in accordance with law. 7. A copy of the order be sent to the transferor court and transferee court. 8. Both the petition stands disposed. ( Dinesh Kumar Sharma, J. )
