Respondent/s BEFORE HON’BLE MR. JUSTICE A. GUNESHWAR SHARMA Order 22.01.2026 [1] This matter is taken up on mentioning due to urgency involved in the matter. [2] Heard Mr. Anjan Prasad Sahu, learned counsel for the petitioners and Mr. H. Debendra, learned Dy. A.G. assisted by Mr. A. Bheigya, learned Jr. G.A. for the State respondent. [3] The petitioners are admittedly encroachers upon the Government land and earlier approached this Court against the show cause notice dated 20.03.2025 issued by the Sub-Divisional Officer, Porompat, ImphalEast and vide order dated 25.03.2025 in WP(C) No. 231 of 2025 with MC(WP(C) No. 219 of 2025, this Court gave liberty to the petitioners to approach the appropriate authority and till the matter is decided by the competent authority, status quo shall be maintained. [4] In pursuance to the direction of this Court vide order dated 05.08.2025, the SDO, Porompat, Imphal East disposed of Eviction Case No. 5 of 2025/SDO(P)/IE after perusing the reply filed by the petitioners and held that the petitioners are encroachers upon the Government land and accordingly, gave direction to vacate the land before 12.08.2025. [5] The order dated 05.08.2025 passed by the SDO, Porompat, Imphal East, has been challenged before the Revenue Commissioner by way of an appeal No. 02 of 2025 and the appeal was closed on 08.10.2025 by giving opportunity to the petitioners to file a fresh representation before the Commissioner after complying all the procedures. Thereafter, the SDO, Porompat, Imphal East issued another eviction notice dated 14.01.2026 for removal of the structures and eviction of the encroachers on 22.01.2026. Against the said order, the petitioners have filed another appeal before the Revenue Commissioner. [6] Mr. Anjan Prasad Sahu, learned counsel for the petitioners, submits that writ petition may be disposed of by directing the respondents to dispose of the pending appeal. [7] Mr. H. Debendra, learned Dy. A.G., submits that the petitioners are not coming to this Court with clean hands and has concealed many documents and he has also raised the question of maintainability of the present writ petition. [8] This Court has perused the materials on record. It is admitted fact that the petitioners are encroachers over the State land. Since the appeal is pending before the appellate authority, it may not be appropriate for this Court to pass any order on the merit of the case. The competent authority is requested to consider the case of the petitioners and dispose of the same. [9] Till the appearance of the petitioners before the appellate authority, status quo as on date may be maintained. This Court does not express any observation on the merit of the case.
