The instant writ application has been preferred by the petitioners for the following reliefs:
“(i) For issuance of appropriate writ(s), order(s) and/or direction particularly a writ in the nature of Certiorari for quashing/setting aside the
order dated 09.03.2016 passed by the respondent no.3, Director, Secondary Education, whereby and whereunder the claim of the petitioners for appointment on the post of Assistant Teachers have been rejected as contained in Annexure-8 to the writ application. (ii) For issuance of further writ(s), order(s) and/or direction(s) including a writ of Mandamus directing the respondents to appoint the petitioners on the post of Assistant Teacher in High School against the vacant posts for which an advertisement was issued by the Jharkhand Public Service Commission for appointment of teachers in different subjects in government High School vide Advertisement no. 12/2008; (iii) For issuance of appropriate writ(s), order(s), and direction(s), quashing and/or staying the advertisement issued for filling up the vacancy

of Assistant Teachers in the districts of Jharkhand as contained in Annexure- 10 to this interlocutory application. (iv) For grant of any other appropriate relief(s) as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case.”
2. From record it appears that this writ application arises pursuant to an advertisement of 2008 and the entire selection process has been culminated in the year 2011 itself. 3. At the outset, Ld. Counsel for the petitioners submits that petitioner no.1 does not want to pursue the instant writ application as he has already been appointed some other place. It has further been contended that still there are vacant seats; as such, the petitioner no.2 may be considered for appointment. 4. In reply to the same, learned counsel appearing for the respondent-JPSC submits that now since the entire selection process is over way back in the year 2011-12 and even the selected candidates have not been made party in the instant writ application; as such, no relief can be granted to the petitioner. 5. Having regard to the aforesaid facts and circumstances of the case that the selection process is over way back in the year 2011-12 and the persons who have been selected by virtue of the advertisement in the year 2011-12; have already secured seniority of around 14 to 15 years, and they have not been made party in this writ application, as such, no relief can be granted to the petitioner. It is immaterial that still there is vacancy of the said post as the vacant seats are carry forward to the next session. 6.
