2. This is an application filed under Section 482 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, seeking grant of pre-arrest bail, apprehending her arrest in connection with Likabali P.S. Case No. 01/2026,
Page No.# 2/3 registered under Sections 329(4)/118(1)/305(a)/74/351(2)/3(5) of the BNS,
2023. 3. The matter relates to a matrimonial dispute between the accused-applicant and her husband, who is allegedly having an illicit relation with the alleged victim. 4. The present accused-applicant has also filed one Criminal Petition being Crl.Petn. No. 44/2026, under Section 528 of the BNSS, 2023, for quashing of the FIR No. 0001/2026 in view of an agreement entered into between the informant, who is the sister of the victim, whereby they have settled the disputes between the informant and the accused-applicant. After hearing of the aforesaid Criminal Petition, this Court has allowed the prayer made and thereby, quashed the FIR No. 0001/2026 dated 03.01.2026 filed against the accused-applicant. 5. It is also seen that, vide an order dated 02.02.2026, a Co-ordinate Bench of this Court has already allowed the accused-applicant to go on interim pre-arrest bail and in terms of the aforesaid interim pre-arrest bail, the accused-applicant is co-operating with the investigation. 6. The learned counsel for the accused-applicant submits that after passing of the interim order dated 02.02.2026, the accused-applicant is fully ready to cooperate with the investigation, however, she did not receive any notice or any request from the Investigating Officer till date for any appearance. 7. In view of the aforesaid submissions, this Court is of the considered view that the interim pre-arrest bail order passed on 02.02.2026 should be confirmed. 8.
Accordingly, the instant Anticipatory Bail application is disposed of by making absolute the interim pre-arrest bail order dated 02.02.2026 in the terms and conditions as stated in the aforesaid order dated 02.02.2026. 9. The instant Anticipatory Bail application is disposed of. Page No.# 3/3
