JUSTICE D K SINGH) The present intra Court appeal has been filed impugning the judgment and order dated 01.08.2025, passed by the Writ Court in W.P.No.22978/2025 filed by the respondents. - 3 - HC-KAR NC: 2026:KHC:27461-DB WA No. 504 of 2026 2. Sri.B.Ravindranath, learned Additional Government Advocate submits that writ petition came to be allowed by the learned Single Judge without affording an opportunity to the respondents/appellants to file their statement of objections to the writ petition. They have taken this ground in this writ appeal that the impugned order has been passed without affording an opportunity to file statement of objections by placing true facts and material on record inasmuch as claim of respondent No.2. 3. Learned Additional Government Advocate appearing for the appellants submits that this writ appeal may be allowed as no opportunity was granted to the appellants to file statement of objections, as the order has been passed without affording an opportunity to file the statement of objections. 4. Considering the aforesaid fact that no opportunity was granted to the appellants to file statement of objections, we set aside the impugned judgment and - 4 - HC-KAR NC: 2026:KHC:27461-DB WA No. 504 of 2026 order and remand the matter back to the learned Single Judge. We direct the appellant to file their statement of objections within a period of two weeks from today. Let the parties be heard afresh and all contentions of the parties are kept open. 5. We request the learned Single Judge to take up the matter on urgent basis and dispose of the same as expeditiously as possible. Accordingly, writ appeal is allowed. In view of disposal of the writ appeal, pending interlocutory application/s if any, does not survive for consideration and the same is disposed of.
