Accused nos.1 to 3 in Crime No.396/2025 registered by Pulakeshinagar Police Station, Bengaluru City, for the offences punishable under Sections 3(5), 316(2), 318(4), 351(2) of BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.396/2025 was registered by Pulakeshinagar Police Station, Bengaluru City, for the aforesaid offences against the petitioners herein based on the first information dated 09.12.2025 received from Abdul Waheed Khan S/o Abdul Majeed Khan. Apprehending arrest in the said case, petitioners had filed Crl. Misc. No.1175/2026 before the - 3 - HC-KAR NC: 2026:KHC:29002 CRL.P No. 3376 of 2026 jurisdictional Sessions Court, which was rejected on 24.02.2026. Therefore, they are before this Court. 4. Perusal of the first information submitted before Pulakeshinagar Police Station, Bengaluru, on 09.12.2025, would reveal that the first informant had entered into an agreement for sale with the accused persons in the year 2018 and subsequently on various dates, he had paid money towards sale consideration of the property which was the subject matter of sale agreement, under bank transaction and also in cash. In the first information, it is alleged that the first informant subsequently learnt that the accused persons had executed similar agreement to sell in respect of the very same property in favour of others. It is under these circumstances, first informant appears to have sought repayment of the amount paid under the agreement for sale. The allegation now made is that the accused persons have threatened the first informant with dire consequences to his life. 5. The dispute between the parties appears to be primarily civil in nature. Petitioners have undertaken to cooperate with the police for the purpose of investigation. The alleged offences - 4 - HC-KAR NC: 2026:KHC:29002 CRL.P No. 3376 of 2026 are triable by the Court of Magistrate and the maximum punishment for the said offences is imprisonment for a period of seven years. Under the circumstances, I am of the opinion that the prayer made by the petitioners for grant of anticipatory bail requires to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.396/2025 registered by Pulakeshinagar Police Station, Bengaluru City, for the offences punishable under Sections 3(5), 316(2), 318(4), 351(2) of BNS, 2023, subject to the following conditions: 1. The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. - 5 - HC-KAR NC: 2026:KHC:29002 CRL.P No. 3376 of 2026 3. Petitioners shall not tamper with the prosecution witness and they shall co-operate with the police for investigation and appear before them whenever called upon. 4.
