“10.1 That, this Hon'ble court may kindly be pleased to direct the respondent authorities to pay the transported amount of Rs. 14,76,218/- of paddy of the year 2019-2020 from Paddy Procurement Center - Balangi and Raghunathnagar to the petitioner within stipulated period. 10.2 That, this Hon'ble court may kindly be pleased to direct the respondent authorities to consider and decided the representations filed by the petitioner ANNEXURE P/3. 10.3 That, this Hon'ble court may kindly be pleased to direct the respondent no.1 to decide the pending arbitration application filed by the petitioner dated 19.3.2021 ANNEXURE P/4 within stipulated period. 10.4 Any other relief or reliefs may also be granted to the petitioner which this Hon'ble court deems fit and proper in the
facts and circumstances of the case.” 2 The subject matter in brief is that, the petitioner is the registered transporter. For the year 2019-20 for transporting paddy, the respondent No.3 executed an agreement on 05.12.2019 for transporting paddy from Paddy Procurement Center Balrampur. The petitioner transported the paddy from Paddy Procurement Center Balangi and Raghunathnagar but the respondent authorities have not paid the transporting amount of Rs 14,76,218/- to the petitioner. The petitioner made several representation before the respondent authorities for payment of the said amount of Rs 14,76,218/-, however, till date the respondent authorities have neither paid the said amount to the petitioner, nor have decided his representations. Hence this petition. 3 We have heard the counsel for the parties and perused the records annexed with the case.
3 4 Perusals of records would reveal that it is purely a civil/contractual dispute between the parties. Both the parties entered into an agreement on 05.12.2019 for transportation of paddy from Paddy Procurement Centre Balrampur. Certain dispute arose between the parties with respect to payment in lieu of transportation of paddy. Clause-17 of the said agreement dated 05.12.2019 specifically provides arbitration clause in case of any dispute between the parties. Further, during the course of hearing it came to the notice of the court that the petitioner has already raised his dispute before the concerned Arbitrator for payment of said amount, however, as has been pointed out by the counsel for the respondents that since Arbitration was filed during Covid period and petitioner could not submit his statement of claim before the Arbitrator, the arbitration proceeding could not be completed and is still pending consideration. 5 In view of aforesaid submissions made by the counsel for the parties, the present writ petition is disposed of reserving the right of the petitioner to pursue his claim before the concerned Arbitrator.
