2. In this writ petition, the petitioner is assailing the order dated 22.05.2026 passed by Respondent No.1-Deputy Commissioner, whereby the
order dated 30.08.2024 (Annexure–B) passed by Respondent No. 2 has been set aside.
3. Sri. Naveed Ahamed,
learned counsel appearing for the petitioner contended that Respondent No. 1 has erroneously interfered with the

order passed by Respondent No. 2, wherein it was held that the petitioner had purchased the land in question under a registered Sale Deed dated
08.09.1944. Therefore, it was contended that the impugned order passed by Respondent No. 1 requires interference by this Court.
4. Per contra, Sri. J.C. Kumar and Sri. Akash V.T., learned counsel appearing for Respondent Nos.4 and 5, submitted that the entry made in M.R. No. 15/1992–93 was interfered with by Respondent No. 2 after a delay of 17 years, despite the fact that civil suits in respect of the subject land are pending
consideration before the competent Civil Court. It was further contended that revenue authorities ought not to have altered the revenue entries when the rights of the parties are subject matter of adjudication in the pending suits.

5. Having considered the submissions made by the learned counsel appearing for the parties, I find force in the contention advanced on behalf of Respondent No. 4. The entry made in M.R. No. 5/1992–93 has been restored by Respondent No. 1 during the pendency of the civil suits concerning the subject land. Since the rights and title of the parties are yet to be adjudicated and crystallized in the pending suits, the order passed by Respondent No. 1 cannot be said to suffer from any legal infirmity calling interference under Article 226 of the Constitution of India. Accordingly, I do not find any ground to interfere with the impugned
order passed by Respondent No.1-Deputy Commissioner.
6. It is, however, made clear that the parties are at liberty to approach the competent revenue authorities for mutation and khata entries after the

rights of the parties are determined by the competent Civil Court in the pending suits. Accordingly, the writ petition stands dismissed.
