This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of B.A. No.3221 of 2026 to its original file. Learned counsel for the petitioner submits that B.A. No.3221 of 2026 was dismissed for non-compliance of the peremptory order of this Court, passed in this case dated 07.05.2026 whereby the petitioner was directed to deposit Rs.1,000/- with the Jharkhand State Legal Services Authority (JHALSA) within four weeks. It is next submitted by the counsel for the petitioner that due to inadvertence the said order could not be complied with within the stipulated time, resulting in dismissal of the said B.A. No.3221 of 2026. It is then submitted that the non- compliance of the peremptory order dated 07.05.2026, passed in the said B.A. No.3221 of 2026 was neither deliberate nor intentional. It is next submitted that the petitioner has very good grounds to agitate in the said B.A. No.3221 of 2026 and unless B.A. No.3221 of 2026 is restored to its original file, the petitioner will be highly prejudiced. It is lastly submitted that a sum of Rs.1,000/- has been deposited with the Jharkhand State Legal Services Authority (JHALSA), a copy of which is annexed as Annexure-2 of the brief. Hence, it is submitted that B.A. No.3221 of 2026 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioners, B.A. No.3221 of 2026 is restored to its original file to the stage at which, it was before its dismissal.
