1. Applicant has filed this sixth bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with Crime No. 298/2023 registered at Police Station – Newai, District Durg (C.G.) for offence punishable under Sections 147, 148, 294, 506B, 323, 324, 307 and 302 of IPC and Section 25,, 27 of the Arms Act,
1959.
2. After arguing for some time, learned counsel for applicant submits that he is not pressing this bail application on merits and seeks permission of this Court to withdraw this application. He however, submits that looking to the period of incarceration of applicant since 05.01.2024, learned Trial Court be directed to expedite the trial. 3. Considering the submission made by learned counsel for applicant this application is dismissed as withdrawn. However, taking note of date of arrest of applicant since 05.01.2024, learned Trial court is directed to expedite the trial and to take all necessary steps and measures as provided under BNSS, 2023 for causing presence of prosecution witnesses.
