JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in C.C.No.654/2023, pending before the Civil Judge and JMFC, Bagepalli, for the offences under Sections 498A, 323, 504, 114 read with Section 34 of the Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act. 2. Heard Sri.Vedachala M.V. learned counsel appearing for the petitioners, Sri.K.Nageshwarappa, learned HCGP appearing for respondent No.1 and have perused the material on record. 3. The parties to the lis were also before the Family Court in M.C.No.1955/2024 and have settled the dispute amongst themselves before the Family Court by terms of Memorandum of Settlement. One of the term of the settlement is, closure of the present proceedings. The said term in the settlement reads as follows: - 5 - HC-KAR NC: 2026:KHC:12126 WP No. 20141 of 2024 “7. Both the petitioners further agree that they have no other claim / demand of whatsoever manner or nature against each other or their respective family members either past, present or future. 8. Both the parties agree that they will withdraw all the allegations made against each other in the other cases. 9. In view of this settlement agreement both the parties have agreed to withdraw the following cases: a) Crl.Misc 39/2023 pending on the file of MMTC-IV, Bengaluru filed by 2nd petitioner. b) M.C.11/2024 pending on the file of III Addl. Senior Civil Judge, Bengaluru Rural, Bengaluru filed by the 1st petitioner. c) 2nd petitioner has agreed to co-operate with the 1st petitioner to close/quash the C.C.No.654/2023 pending on the file of Civil Judge & JMFC, Bagepalli, Chikkaballapura. d) Both the petitioners further state that there has been no collusion or force, fraud or any undue influence in entering into this settlement / agreement in the aforesaid manner. e) Both the petitioners admit that they shall not interfere in the lives of each other in future.” 4. Therefore, in light of the settlement arrived at between the parties quoted supra and offences not being against the State, I deem it appropriate to terminate the proceedings against the petitioners in the subject petition. - 6 - HC-KAR NC: 2026:KHC:12126 WP No. 20141 of 2024 5. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed.
