The petitioner is serving as Trained Graduate Teacher (Non-Medical) at Government Senior Secondary School, Barthin, District Bilaspur. Her grievance is to the office order dated 01.09.2026 (Annexure P-3), whereby she has been transferred to Ghareen u/c Government Senior Secondary School, Maraog, Shimla.

Learned counsel for the petitioner submitted that petitioner’s stay at Government Senior Secondary School, Barthin, is

2 around two and a half years, however, by clubbing her postings at nearby stations, her stay comes to around 8 years. Another ground urged was that the impugned order has been issued on the basis of a D.O. Note and out of malice, in view of the posting of petitioner’s husband at Shaheed Vijay Pal Memorial PM Shri Mukhyamantri Adarsh Government Senior Secondary School, Ghumarwin, District Bilaspur, pursuant to the orders passed in CWP No. 13889 of 2026.

Since it is not in dispute that the petitioner has completed almost 8 years in and around her present place of posting, and has also completed two and a half years at the present place of posting, the impugned order dated 01.09.2026, transferring the petitioner from Government Senior Secondary School, Barthin, District Bilaspur, cannot be faulted. However, at this stage, learned counsel for the petitioner pointed out that, being a couple case, the petitioner has preferred a representation at Annexure P-4 to respondent No. 2, seeking her transfer to Government Senior Secondary School, Ramsehar, District Solan, where a vacancy is stated to be lying vacant. Learned counsel for the petitioner submits that the petitioner would be satisfied in case respondent No. 2/competent authority is directed to consider and decide her representation, in accordance with law, within a time-bound manner.
Learned counsel for the respondents have no objection to this prayer.

4. In view of above facts of the case, this writ petition is
disposed of by directing respondent No. 2/competent authority to consider and decide the representation of the petitioner at Annexure P-4, in accordance with law, keeping in view the facts outlined therein as also the applicable transfer policy, within one week. The order so passed be also communicated to the petitioner. It shall be open for the petitioner to avail the leave of kind due till the decision on the representation. Pending miscellaneous application(s), if any, shall also stand disposed of.
