GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue a Writ, Order or direction particularly, one in the nature of Writ of Mandamus declaring the action of Respondent No.5 and their staff without any authority of law, has been repeatedly calling the petitioner to the Respondent No.5 police station with the active support and influence of the 6th Respondent and making him sit there for prolonged hours without the registration of any crime or any reason or justification and threatening him to handover the empty signed promissory notes and cheques to the 6th Respondent and the said actions are arbitrary, illegal, and violative of Articles 14,19, and 21 of the Constitution of India and consequently direct the Respondent No. 5 police authorities not to call the petitioner unnecessarily to the Respondent No.5 police station without following due procedure established by the law and pass.…” 2. Heard learned counsel for the Petitioner and the learned Assistant Government Pleader. 3. Mr. Venkata Durga Rao Anantha, learned counsel for the Petitioner, submits that the Petitioner was unnecessarily called to the Police Station at the behest of the 6th Respondent and detained there for prolonged hours without the registration of any crime or any valid reason or justification. He further submits that the Petitioner was coerced into handing over signed blank promissory notes and cheques to the 6th Respondent without following due process of law. 4. Sri P. Ajay Babu, learned Assistant Government Pleader would submits that the police authorities acted strictly in accordance with law and did not subject the Petitioner to any illegal harassment or coercion. 3 5. Having regard to the facts and circumstances of the case, and considering the submissions made by the learned counsel for the Petitioner as well as the learned Assistant Government Pleader, the Writ Petition is disposed of directing the Investigating Officer to strictly follow the procedure contemplated under the provisions of the BNSS. The Investigating Officer shall not unnecessarily call the Petitioner to the Police Station or subject him to harassment, coercion, or embarrassment, except in accordance with due process of law. The Investigating Officer shall scrupulously adhere to the provisions of the BNSS while conducting the investigation. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ________________________ Dr.Y.
