This writ petition has been preferred by the petitioner under Article 226 of the Constitution of India, seeking following reliefs:- “10.1 That, Hon’ble Court may kindly be pleased to direct the respondent authorities to issue the final mark sheet to the petitioners for the Dl.Ed. Course. 10.2 Any other relief which this Hon’ble Court deems fit and proper may also be DEEPTI JHA Digitally signed by DEEPTI JHA 2 passed in favour of the petitioner together with cost of the petition.” 3. Learned counsel for the petitioner submits that prayer of the petitioner is that final marks sheet of the petitioner of Elementary Education, Dl.Ed be issued online. Vide letter dated 29.06.2019 (Annexure-P/3), respondent No.3/Principal has already forwarded the marks obtained by the petitioner to the respondent No.2, but till date the said result was not uploaded in the portal. Respondent No.3 has duly recommended the case of the petitioner for sending final marks sheet, the same has not been uploaded due to the fault on the part of respondent authorities and petitioner is not responsible for the same in any way. 4. Learned counsel appearing for the respondents No.1 & 2 submits that since the last date of uploading the result has already been expired, as such the result could not be uploaded. It is further submitted that there is provision that the result should not be uploaded after the expiry of last date of submission. It is further submitted that there is no any defect committed by the respondent authorities, for which the petitioner was deprived from the result. 5. Taking into consideration the facts and circumstances of the case, particularly considering the fact that vide letter dated 29.06.2019 (Annexure-P/3), the respondent No.3/Principal, District Institute of Education and Training (DIET), Maharajpur, District Kabirdham (C.G.) has already sent the requisite information in respect of the marks obtained by the petitioner, however, the said information has been sent belatedly by him, which is also not a fault of the petitioner. 6. Further, considering the aforesaid aspect of the matter, the facts and circumstances of the case and for the reasons assigned therein, the respondent No.3/Principal is directed to provide requisite documents and the marks obtained by the petitioner to the respondents No.1 & 2 within a period 3 of four weeks from the date of passing of this order and in turn respondents No.1 & 2 shall consider the same and upload the result of the petitioner within further period of three months, in the interest of justice. As there is no fault by the end of the petitioner and the petitioner may not suffer for the delay and laches of the authorities. 7. It is made clear that this order shall not serve as a precedent for any other matter and is being passed solely in the interest of the petitioner in the present case. 8.
