This is the 2nd bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the Applicant who has been arrested in connection with SISTLA NEELIMA VISHNU PRIYA Digitally signed by SISTLA NEELIMA VISHNU PRIYA Date: 2026.06.18 14:49:00 +0530 2 Crime No.48/2025 registered at Police Station – Durgukondal, District- North Bastar, Kanker (C.G.), for the offences under Sections 64(1) and 351(2) of the BNS, 2023. Earlier application was rejected on merits vide order dated 19.03.2026 passed in M.Cr.C. No.2585/2026. 2. As per the case of the prosecution, on 18.12.2026, the present Applicant allegedly took the victim to a secluded place near Hahaladdi Pahadi Temple within the jurisdiction of Police Station Durgukondal and forcibly established physical relations with her against her will by threatening and intimidating her. It is further alleged that the present Applicant threatened the victim with dire consequences if she disclosed the incident to anyone. Based on the aforesaid allegations, the police registered the offences as mentioned above against the present Applicant. Hence, this application. 3. Learned counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is contended that the victim was a consenting party and in her statement recorded before the trial Court, she has admitted that she was in regular contact with the Applicant through mobile phone. It is further submitted that the Applicant has been in judicial custody since 22.12.2025, the charge-sheet has already been filed and the conclusion of 3 trial is likely to take considerable time, therefore, it is prayed that the Applicant may be enlarged on regular bail. 4. On the other hand, learned State Counsel opposes the bail application and submits that the Applicant's earlier bail application was rejected on merits. It is, therefore, argued that in the absence of any substantial change in circumstances, the Applicant is not entitled to be released on bail. 5. Having heard learned Counsel for the parties and considering the facts and circumstances of the case, particularly the nature and gravity of the allegations, this Court is of the view that the mere fact that the victim was in telephonic contact with the Applicant would not, by itself, establish that the physical relationship between them was consensual. Further, the Applicant's earlier bail application was rejected on merits and no substantial change in circumstances has been pointed out, therefore, this Court is not inclined to grant bail to the Applicant, at this stage. Accordingly, the bail application is rejected. 6. Accordingly, the bail application of the applicant – Pratap Haldar involved in Crime No. 48/2025 registered at Police Station – Durgukondal, District- North Bastar, Kanker (C.G.), for the offences under Sections 64(1) and 351(2) of the BNS, 4 2023, is hereby rejected. 7.
