1 The petitioner has filed this petition seeking following reliefs:
“That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, order or direction directing the Respondent Authorities more particularly Respondent No. 3 to complete the investigation and file the final report within a stipulated period and further direct the respondents to forthwith provide a copy of the final report to the petitioner in connection with FIR No. INDRAJEET SAHU Digitally signed by INDRAJEET SAHU Date: 2026.06.18 15:21:31 +0530

Facts of the case as projected by the petitioner is that, the husband of the petitioner namely Dharmendra Patel, while performing VIP duty as Constable, posted at Police Station Janakpur, District Manendragarh- Chirmiri-Bharatpur, met with a road accident on 27.10.2024. During the course of treatment at Ramakrishna Care Hospital, Raipur, he succumbed to the injuries on 13.11.2024. Thereafter, an FIR No.0373/2024 was registered on 17.12.2024 for the offences punishable under Sections 281 and 125(a) of the Bharatiya Nyaya Sanhita, 2023, however, despite lapse of considerable time, the respondent authorities have neither completed investigation nor have filed the closure/final report before the competent Court, on account of which, the petitioner is facing difficulty in obtaining insurance claim, pensionary and other consequential service benefits. Though FIR was lodged on 17.12.2024, however, till date neither investigation is completed nor police has filed Final Report before the competent Court. Therefore, by way of this petition the petitioner seeks a direction to complete the investigation and to place final report at the earliest. 3
Learned counsel for the petitioner would submit that despite lapse of substantial time from the date of incident and registration of FIR, no charge-sheet/final report has been filed by the police till date before the competent court of law on account of which she is facing difficulty in getting pensionary, death claim and other dues of her husband. The petitioner apprehends that investigation is not proceeding in a fair and proper manner. He would further submit that inaction and delay on the part of police authorities is causing grave prejudice to the petitioner
3 and defeating the cause of justice. Therefore, the petitioner has approached this court for issuance of a direction to the concerned police authority to complete the investigation forthwith. 4 Having Considered the contentions put forth by the counsel for the petitioner; considering the fact that alleged accident took place on 27.10.2024 and FIR having been lodged by the petitioner on 17.12.2024, till date there is no substantial progress and the police authorities have not submitted Final Report under Section 193 of BNSS, therefore, the Superintendent of Police, Ambikapur, District Surguja, is directed to ensure that investigation of FIR No.0373/2024, registered at Police Station, Sitapur, District Surguja, is carried out in a time bound manner and the same be concluded within a period of four weeks from the date of production of copy of this order. 5 With the aforesaid observations/direction, the present petition stands
