Neutral Citation No. ( 2026:JHHC:21136 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI Cr. Revision No. 463 of 2025 Ashish Mandal, S/o Loknath Mandal, R/o Simuldan, Kalubathan O.P., P.O. + P.S.- Nirsa, District- Dhanbad … … Petitioner Versus The State of Jharkhand … … Opposite Party ---------- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY ---------- For the Petitioner : Mr. Gautam Kumar, Advocate For the State : A.P.P. For the Informant : Ms. Savita Kumari, Advocate ---------- 06/17.07.2026 Heard Mr. Gautam Kumar, learned counsel for the petitioner and learned A.P.P. as well as Ms. Savita Kumari, learned counsel appearing for the informant. This application is directed against the order dated 18.11.2024, passed by the learned District & Additional Sessions Judge-VII, Dhanbad in S.T. Case No. 934/2022, arising out of Nirsa Kalubathan P.S. Case No. 139/2022, corresponding to G.R. No. 233/2022, whereby and whereunder, the application preferred by the petitioner for recall of the informant for further cross-examination has been rejected. A perusal of the impugned order dated 18.11.2024 reveals that the informant who has been examined as P.W.4 was cross-examined consecutively for a period of two days and subsequent thereto he was discharged. In fact, the petitioner has failed to enumerate any circumstance which would implore this Court to reverse the order passed by the learned trial court on 18.11.2024. Ms. Savita Kumari, learned counsel for the informant has submitted that the matter has been compromised between the parties. This is a case under Section 302 of the IPC which is not compoundable in nature and the subsequent development appears to be the primary ground which has been taken by the petitioner for recall of P.W.4 for his further cross-examination. The learned trial court has appropriately considered the entire issue in its proper perspective and having found no merit in this application, the same stands dismissed. However, this order will not prejudice the case of the petitioner before the learned trial court. (Rongon Mukhopadhyay, J.) Dated, the 17th July, 2026 A. Sanga/- Uploaded on 27 /07/2026 -2-
